I want to make a claim under section 75 of the Consumer Credit Act, what are my rights?

Under Section 75 of the Consumer Credit Act 1974, you're covered if something goes wrong with new or second-hand goods you've purchased on your credit card in the UK or abroad.

Under Section 75, you could be entitled to compensation from Barclaycard, if goods you've bought on your credit card are:

  • Faulty
  • not delivered
  • or the information given about them was misleading

You’ll be able to make a Section 75 claim as long as:

at least part of the goods or services were purchased on your credit card by you, the main cardholder (additional cardholders or third parties won't be covered)

the single value of the one item is between £100 to £30,000
the purchase was made less than six years ago
your purchase was not made through a third party like Alibaba, Amazon Marketplace, Clearpay, Curve, PayPal, Western Union or Klarna. They might not be covered; however, these third parties may have their own protection schemes. If the retailer uses PayPal to take payments and you’ve used your Barclaycard as normal, you’ll still be covered by Section 75

How do I make a Section 75 claim with Barclaycard?

If you use the Barclaycard app, you can make a claim. Simply click on the transaction you wish to dispute, select 'Help with this transaction' and follow the steps – Barclaycard team will explain what we need at every step.

My trip or event has been cancelled. How can I claim my money back?

If your trip or event has been cancelled, we’d recommend that you start by getting in touch with whoever organised it, or whoever you booked it with. They may offer you different dates or a full refund. This is likely to be the quickest way to get the resolution you want.
If you’ve spoken to them and they can’t offer you a suitable alternative or a refund, BarclayCard team can help you by logging a dispute. If you can provide evidence of your contact with them and their response, that could help support your claim.

Holiday Packages, the flight, hotel and other activities cancelled.

Mia booked a package holiday but before leaving some significant parts of the holiday have been cancelled due to a change in the local circumstances.

Could Mia claim?

Yes, Mia is entitled to a full refund for all parts of the holiday that made up the travel package. As she bought the holiday as a package the retailer is required to protect all parts of it under the Package Travel Regulations.
If she’d bought the flight, hotel and other activities separately she’d only be able to claim for the parts cancelled by the supplier. She should first try to claim through the holiday provider but if this is unsuccessful, Barclaycard will attempt to claim on her behalf.

Hotel and Flights Cancelled

Helen booked her flights and hotel separately, but now the airline has had to cancel her flight and she isn't able to get to her destination. The hotel is refusing to refund her if she cancels her booking.

Could Helen Claim?

Helen should first check the cancellation policy for the flights and hotel. She does have the right to claim a refund on her credit card for the airline ticket but not the hotel. This is because the hotel has not failed to provide its service, unlike the airline. She may be covered under her holiday insurance for the cost of the hotel but should check this with her insurer.
